Mediation offers separating couples and their children a way forward without the considerable trauma and expense of court proceedings. Mediation enables clients to reach their own decisions focusing on their own and the needs of any children in the presence of an impartial mediator who is there to assist with discussions and to ensure the focus is on how to improve arrangements for the future.
Whilst any agreements reached are not binding in themselves [“without prejudice”] they can be converted into agreements by legal advisers.
Throughout clients are strongly recommended to obtain independent legal advice on particular issues as they arise and most definitely when agreement is reached.
We offer mediation at a fixed fee rate and these costs are significantly lower than issuing court applications. Whilst clients still need their own individual legal advice this can very much be ring fenced by lawyers who will have the advantage of fully written information prepared by the mediator namely schedules of financial disclosure together with written details of proposals. Alternatively if clients prefer the negotiations in the presence of their own lawyers we can offer the collaborative law process again enabling clients to focus on their own outcomes with the benefits of legal advice.
At the start of the process we always have an initial meeting either on an individual or joint basis to consider whether mediation is both helpful and suitable. As part
of this process, we can provide the certificate required by any applicant in Family Proceedings, unless exempt as requested by the courts from the 6th of April 2011.
Our department is headed by Andrea Sorrell who is an experienced mediator and trained collaborative lawyer. Andrea Sorrell is a member of the Law Society Mediation and Family Law Panels and a member of Resolution and is an accredited mediator/supervisor with National Family Mediation.
